La libertad de pensamiento y de expresión vista desde la Corte Interamericana de Derechos Humanos

En el texto se estudia el derecho a la libertad de pensamiento y de expresión, según la Convención Americana de Derechos Humanos, así como la manera en la que ha sido interpretado y aplicado este derecho en la Corte Interamericana de Derechos Humanos. Se acude a sentencias, a votos razonados y a opiniones consultivas de este tribunal. Se discute además sobre derechos que han representado tensiones (como el derecho a la honra y a la dignidad) y la manera en la que la Corte se ha pronunciado en relación con estas tensiones. Posteriormente se analiza el primer asunto que la Corte conoció sobre este derecho, "La última tentación de Cristo" (Olmedo Bustos y otros) vs. Chile. Esto sirve para conocer la manera concreta de actuación de la Corte y del Estado chileno.

In this text, we study in the first place the nature, components and limitations of the right to freedom of thought and speech, according to the American Convention on Human Rights, as well as the manner in which this right has been interpreted and applied in the Inter-American Court of Human Rights. We turn to sentences, Separate Opinions and Advisory Opinion of this tribunal. We also discuss the rights that have represented tensions (such as the right to honor and dignity) and the manner in which the court has pronounced itself with respect to these tensions. Subsequently, we analyze the first case that the Court knew about this right, "The last temptation of Christ" (Olmedo Bustos and others vs. Chile). This allows the study of the con cre - te way in which the Court and the Chilean State act.
