El derecho en su dimensión individual y social según John Locke

En este artículo se analizan los principios del empirismo, el origen de la libertad, del derecho natural y de la ley natural. Se expone luego el origen de la sociedad y del derecho civil, y las relaciones entre el derecho individual a la libertad y la limitación civil de ese derecho. Según Locke, lo ideal de una sociedad cívico-política consiste en que la mayoría puede, por libre consentimiento y pacto, constituir una sociedad donde los hombres sean iguales e independientes de un poder absoluto y, por convenio, permitirse una vida cómoda, segura, pacífica, disfrutando de los propios bienes. Se expone luego la concepción lockiana del derecho al poder civil público y su división. Se trata el pacto constitutivo de la sociedad civil y los derechos a la educación. Se hacen finalmente algunas observaciones sobre la ley natural, y la propuesta interpretativa de Locke. Si bien se presume que la ley natural es objetiva e innata, queda, sin embargo, reducida al esfuerzo de interpretación de cada hombre. La ruptura epistemológica de la modernidad, también en materia moral, significa, entonces, pasar del objetivismo moral al interpretacionismo moral.

This paper aims at analyzing the principles of empiricism and the origin of freedom, natural right and natural law. Then it describes the origin of societies and civil law, as well as the relationships between the individual right to freedom and the civil restrictions imposed on that right. According to Locke, the ideal of a political-civic society would be for the majority to be able to constitute, by means of free consent and pacts, a society where men are equal and independent from an absolute power and in which men, by agreement, allow themselves a comfortable, safe and pacific life enjoying their own goods. The paper then presents Locke is views on the right to public civil power and its division, and then develops civil society constituent pact and rights to education. Lastly, some observations are made on natural law and Locke is proposed interpretation. Natural law is assumed to be objective and inborn, although, nonetheless, limited to each man is interpretative effort. Therefore, modernity epistemological break means –even in moral matters– shifting from moral objectivism to moral interpretationism.
