EL NON BIS IN ÍDEM COMO FÓRMULA DEL PRINCIPIO DE LEGALIDAD QUE PERMITE EL INGRESO DEL ESTATUTO DE ROMA AL DERECHO INTERNO

El siguiente artículo tiene por objeto analizar una de las primeras consecuencias que se presentan en virtud de la adopción del Estatuto de Roma de 1998 para la adopción de la Corte Penal Internacional, en concreto desde los efectos que se desarrollan tanto a nivel de non bis in ídem y cosa juzgada, como integrantes del principio de legalidad, desde la perspectiva del instrumento referido frente al derecho interno. En tal sentido, se examinarán los efectos que se presentan tanto a nivel del non bis in ídem material, centrado en el punto de la determinación de conductas objeto de investigación y de su presunto responsable, como en el non bis in ídem procesal que se establece a través del alcance de la res judicata y su posible relativización, derivada de las ya flexibles estructuras de los principios concebidos en el derecho interno, que constituyen sin duda, la puerta de entrada del instrumento examinado al sistema nacional.

The following article is a product of the research called "Influence the international instruments from the International Criminal Law in the principle of legality in the criminal matter in Colombia", the aim is: to analyze one of the first consequences that are shown in the adoption of the Rome statute from 1998 for the International criminal court and its relevant meaning, and their fundamental rules, such as the principle of ne bis in ídem and its relation with de principle of legality, and its effects in the criminal matter in Colombia. In fact we can see some important consequences, in the material ne bis in idem, that analyse, the concept in front of the specific elements of crime and their possible responsibility in the internal laws, and the concept of the procedure ne bis in idem and its relative concept in our legislation, that permit all of the effects of the Rome Statute in our legislation.
