El lugar de arbitraje y la "deslocalización" del arbitraje comercial internacional

Este artículo analiza la problemática relativa a la concreción del lugar de arbitraje en el actual contexto comercial y tecnológico, altamente globalizado, haciendo referencia a los desarrollos legales que se han llevado a cabo en esta materia en España y en América Latina. De este modo, en el mismo se analizan, por un lado, fenómenos como los "arbitrajes en línea" (vinculados a la aparición de sistemas de resolución de conflictos en línea -ODR-) o los "arbitrajes itinerantes"; así como, por otro lado, se destaca la tendencia hacia la deslocalización" del arbitraje comercial internacional, tiñéndolo de un marcado carácter "anacional", en donde la concreción de la sede es empleada simplemente para elegir una normativa arbitral adecuada o para atender a las conveniencias del propio procedimiento arbitral, o las de los árbitros.

This article analyzes the relevant issues concerning the localization of the place of arbitration in the current highly globalized trade and technology, referring to the legal developments that have taken place in this field in Spain and Latin America. Thus, on the one hand, phenomena like "online arbitration" (linked to the use of Online Dispute Resolution -ODR- systems) or"mobile arbitration" are analyzed. And, on the other hand, the trend towards "de-localization" of international commercial arbitration is underlined; turning it into a "non-national" arbitration, in which the determination of the seat is used simply to choose appropriate arbitration rules or even to meet the convenience either of the arbitral process or of the arbitrators.

Español Este artículo analiza la problemática relativa a la concreción del lugar de arbitraje en el actual contexto comercial y tecnológico, altamente globalizado, haciendo referencia a los desarrollos legales que se han llevado a cabo en esta materia en España y en América Latina.
