LA PROTECCIÓN DE LOS DERECHOS ECONÓMICOS, SOCIALES Y CULTURALES EN EL SISTEMA INTERAMERICANO DE PROTECCIÓN A LOS DERECHOS HUMANOS

El artículo proporciona un modelo teórico de análisis de las obligaciones dimanantes de los derechos económicos, sociales y culturales que distingue la obligación de garantizar un mínimo esencial de estos derechos de la de procurar el desarrollo progresivo de los mismos. Lo anterior, con la finalidad de verificar si este modelo resulta aplicable a la estructura argumentativa que ha seguido la Corte Interamericana en sus sentencias para declarar la violación de los derechos contenidos en la Convención Americana relacionados con la protección de los denominados derechos económicos, sociales y culturales.

The article provides a theoretical model for analysis of the obligations emanating from economic, social and cultural rights that distinguish the obligation to guarantee an essential minimum of these rights from that of attaining the progressive development of the same. The foregoing has the objective of verifying if this model is applicable to the argumentative structure that the Inter-American Court has followed in its sentences to declare a violation of the rights contained in the American Convention related with the protection of economic, social, and cultural rights.
